Terms of Service

1. Agreement to These Terms

By creating an account, placing an order, starting a meal program, or otherwise using the Harvest Clean Food website, mobile experience, or meal-delivery service (together, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Harvest Clean Food (registered in Thailand). Questions? Email hello@harvestcleanfood.com.

2. Account Registration and Security

You do not need an account for a single order, but creating one lets you track orders, manage subscriptions, and earn loyalty points. When you create an account, you agree to:

  • Provide accurate, current, and complete information (name, email, phone number, delivery address) and keep it up to date.
  • Keep your login link / session token confidential and not share it with others.
  • Notify us immediately at hello@harvestcleanfood.com if you suspect unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account, including orders placed and payments made.

We use a magic-link, password-free login for security. Login links expire after 15 minutes and are single-use. We will never ask for your password by phone or email.

3. Orders, Prices, and Payment

3.1 Ordering

An order is confirmed when you receive an order confirmation email and a payment authorization succeeds. We reserve the right to decline or cancel an order if we are unable to fulfill it (e.g. a menu item becomes unavailable) — in which case we will refund any payment in full within 3 business days.

3.2 Prices

Prices are shown in Thai Baht (฿) and include applicable VAT unless stated otherwise. Delivery fees apply to orders under ฿999 (currently ฿89). Prices may change. The price shown at the time you complete checkout is the price you pay for that order.

For active subscribers, price changes are communicated at least 14 days in advance by email. You may cancel before the new price applies without penalty.

3.3 Payment Methods

We accept Visa, Mastercard, American Express, and PromptPay. All card transactions are processed by Omise Co., Ltd. (PCI DSS Level 1 certified). We do not store card numbers, CVV codes, or expiry dates — only the payment token issued by Omise.

3.4 Failed Payments

If a payment fails for a one-off order, your order will not be processed and you will be notified by email. For subscription renewals (Section 4), we retry once within 24 hours. If the second attempt also fails, your subscription is paused for that week and you will be notified.

4. Subscriptions — Billing, Skip, Pause, and Cancellation

4.1 Renewal Cycle

Meal plan subscriptions renew on a weekly cycle. We pre-authorize your card on file each Sunday evening (by 10 PM Bangkok time)for the upcoming week's deliveries. If the pre-authorization succeeds, the charge is settled Monday morning and a receipt is emailed to you.

4.2 Introductory Pricing

New subscribers receive introductory discounts for the first four weeks:

  • Week 1: 50% off the regular weekly rate
  • Week 2: 25% off
  • Weeks 3 and 4: 15% off
  • Week 5 onward: regular rate

Pausing or skipping a week does not reset or forfeit your introductory discount position. If you cancel and re-subscribe, introductory pricing does not re-apply.

4.3 Skipping a Week

You may skip any upcoming week's delivery through your dashboard. To skip, you must confirm the skip before Sunday 8 PM Bangkok time for the following week. Skips confirmed before this cutoff are free and no charge will be made for that week.

Skips requested after Sunday 8 PM will apply to the week after, not the immediately following week.

4.4 Pausing a Subscription

You may pause your subscription for any number of consecutive weeks through your dashboard. Pauses take effect for the week following Sunday 8 PM. During a pause, no charges are made and no deliveries occur. Your subscription resumes automatically on the week you specify, or on the next available delivery week if you resume early.

4.5 Cancellation

You may cancel your subscription at any time through your dashboard under “My Plan → Cancel Plan.” Cancellations confirmed before Sunday 8 PM take effect for the following week — you will not be charged after cancellation.

If you cancel after Sunday 8 PM, the charge for the following week has already been authorized and that delivery will proceed. The subscription ends after that delivery.

There is no cancellation fee. We will ask for a brief reason for your cancellation (optional) so we can improve.

5. Delivery and Safe Receipt

We deliver to the Bangkok districts and Pattaya areas listed at /delivery. If your address is outside our current delivery zones, we will notify you before processing payment.

You are responsible for ensuring that someone is available to receive the delivery within your chosen time window (Morning 8–11 AM, Midday 11 AM–2 PM, or Afternoon 2–5 PM), or for providing a specific safe-drop location (security desk, lobby, building office). We are not liable for meals that are left unattended after a successful delivery confirmation.

Once delivered, refrigerate your meals immediately and consume within 48 hours. Meals left outside a cold chain for extended periods should be discarded. We are not responsible for meals that deteriorate due to improper storage after delivery.

6. Allergens and Dietary Requirements

Our kitchen handles common allergens including gluten, dairy, soy, eggs, peanuts, tree nuts, fish, and shellfish. While we take care to prevent cross-contact, we cannot guarantee an allergen-free environment. Customers with severe or life-threatening allergies should consult a medical professional before ordering and contact us directly at hello@harvestcleanfood.com to discuss your specific needs.

Allergen information displayed on each meal card is provided in good faith based on ingredient lists from our suppliers. We are not liable for reactions caused by undisclosed ingredient changes by third-party suppliers, provided we update our meal cards as soon as we become aware of any change.

7. Refunds and Credits

Full details of our refund policy are at /refund-policy. In summary:

  • Quality issues (e.g. spoiled or incorrect meal) reported within 24 hours of delivery with photographic evidence are eligible for a full refund or replacement.
  • Deliveries that were not made due to our error are eligible for a full refund or rescheduling.
  • Change-of-mind cancellations of one-off orders are not eligible for a refund once the meal has been prepared (generally, after 10 PM the night before delivery).
  • Subscription weeks cancelled before the Sunday 8 PM cutoff are not charged.

Refunds are processed within 3–5 business days to the original payment method.

8. Intellectual Property

All content on the Service — including recipes, photography, nutritional data, copy, branding, design elements, and software — is owned by Harvest Clean Food or its licensors and is protected by Thai and international intellectual property law. You may not copy, reproduce, distribute, publicly display, or create derivative works from any part of the Service without our prior written permission.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Limitation of Liability

To the fullest extent permitted by Thai law, Harvest Clean Food's total liability for any claim arising out of or in connection with these Terms or the Service is limited to the amount you paid us in the three months preceding the event giving rise to the claim.

We are not liable for:

  • Indirect, incidental, special, or consequential damages of any kind;
  • Loss of profit, revenue, data, goodwill, or business opportunity;
  • Damages arising from your failure to follow storage instructions;
  • Delays or non-delivery caused by force majeure events (including natural disasters, widespread infrastructure failure, or government orders).

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded or limited under applicable Thai law.

10. Changes to These Terms and Governing Law

We may update these Terms from time to time. Material changes — such as new limitations on liability, changes to the subscription cutoff time, or changes to our refund policy — will be:

  • Posted on this page with a new “last updated” date;
  • Emailed to all active subscribers at least 14 days before the change takes effect.

Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Thailand. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
